Eminent Domain Whiplash

Justice Souter had no problem siding with big business (proxied through the New London, Conn. City Council) to apply the eminent domain standard. Now, there is a possibility that his own home in New Hampshire could be taken using the leverage he provided.

Souter didn’t vote on this alone – why pile only on him? Why not also act against the “liberal” judges who have decided to screw the little man?

Anyone who voted with the majority on this one is at fault. Souter gets the shaft here because he may soon get to feel his own idiotic wistake first hand, while all of them probably felt comfortable that their houses would never be bulldozed to make way for a new shopping center.
